General Conditions of Sale and Use

 1. Identification of the Seller

 2. Scope of general conditions of sale

The customer’s order implies the acceptance of the whole general conditions.
The language available for the conclusion of the contract of sale is French.

 3. Offers validity

Items visible on the site are available while quantities last. However, it may be that a product ordered is no longer available and not renewed by the supplier. IceOptic.com will inform the customer as soon as possible by email for a refund or an exchange of the item.

 4. Products prices

The prices are indicated in euros, all taxes included, excluding shipping costs for Metropolitan France. All prices include legal VAT, applicable on the day of the order. Any change in the VAT rate can be reflected on the price of the items unless your order has already been registered.

Prices of the products for Overseas, Switzerland and the rest of the world are shown Duty Free. Customs duties, local taxes, import duties or state taxes are likely to be due. These fees and sums will be at your expense and are entirely your responsibility, both in terms of declarations and payments to the competent authorities. We are not required to verify and inform you of applicable customs duties and taxes. We advise you to inquire about these aspects with your local authorities as your parcel may be subject to customs’ inspection.

 5. Prescription glasses

Optical activity is exercised in the strict application of the regulatory framework of the Opticien-lunetier profession. As such, Mr. Denis Chaussin is a state graduated optician, registered by the Regional Health Agency under the ADELI number 742806839.

The ophthalmologist will issue you a medical prescription following your consultation. It will be valid for 3 years unless stated otherwise. You can therefore renew your glasses if you have a prescription less than 3 years old.

Depending on your choice, you can receive a free online estimation for the frame, corrective lenses, or corrective sunglasses. It will include the delivery time, the deadline for the validity of the quotation, the conditions of sale and payment, the conditions of after-sales service. You will have to validate it by email.

 6. Order and Secure Payment

For the first order, the customer will have a form to fill out: first and last name, delivery address, email, date of birth and telephone number. The customer’s area will be completely secured by a password.
Before validating an order, the customer will have to check the characteristics of the item such as size, color, packaging, etc. After clicking on the “validate” icon, the command will be saved. When the customer validates his order this implies the acceptance of these General Conditions of Sale.
After having validated his method of payment, the customer definitively and irrevocably validates his order. The price is due immediately on the date of the order.

You can pay by credit card (CB, Visa, Mastercard). The customer validates his delivery and billing address, the product and the total price. He provides his card number, the expiration date and the CVX code. He validates his order by clicking on “confirm”.

You can pay with Paypal. This payment method allows you to pay online without communicating your financial information to the seller during the transaction.

You can pay with check (France only). The check must be in euros, to Optique Chaussin and send by mail with your order form signed, to the following address:

The order will only be processed when your check arrives and is validated by the bank, increasing the delivery time.

The order will only be processed when we receive the transfer, increasing the delivery time. Fees are likely to be requested by your bank, at your expense.

You can make the payment by calling us, we will allow the transaction by VPC.

Payment in several times with Alma. A payment several times, by credit card only, is offered to customers under eligibility conditions. To take advantage of this, the customer must accept the Alma terms and conditions.
Payment in 2 times is available at a rate of 0.78%
Payment in 3 timesis available at a rate of 1.55%
Payment in 4 times is available with a rate of 2.32%
In case of total rupture on an order paid in several times, the order is cancelled, the Customer is refunded of the sums paid including the file fees and the deadlines are cancelled.
If an item is returned in a multi-product order, the following deadlines are changed automatically.
In case of return of all the products of an order and after positive examination of the products by our warehouse, the Customer is refunded with the exception of the application fee and the deadlines are cancelled. In all cases of unpaid payments, the remaining maturities are cancelled and the amount requested for recovery is equal to the total of the remaining amount due by the Customer.
Payment in batches is not possible in the case of a product exchange with payment, that is to say when the exchanged product is more expensive than the original product.
When offered, this method of payment is indicated on the payment page of the order.

IceOptic.com reserves the right to own the item until payment is made.

 7. Payments verification

IceOptic.com controls every orders validated on its website. These controls are made to protect us from abusive practices. We reserve the right to refuse an order placed on our website without the customer being able to claim any compensation, in case of manifest error on the website concerning the ordered product, error on the price or when the solvency of the customer is not guaranteed.

 8. Payments security

We use the Marc@net solution from the bank BNP Paribas. E-payment is developed around SIPS technology (Secure Internet Payment Services) and Atos Worldline C.
This service integrates the SSL standard (Secure Socket Layer), a data encryption that secures information transfer over the Internet.
This service also integrates the PCI DSS, we are not aware of the data of your card, it is routed in real time on the secure remote payment manager of the bank BNP Paribas.

 9. Identification

The seller collects, stores and processes the personal data of the customer obtained within the framework of the contractual relationship, according to the law relating to the protection of personal data.
Customers, to login, must register his email address and choose a password. This password is strictly confidential and should not be disclosed. If it is forgotten, we will return it to you upon request.
In order to facilitate its identification, the customer authorizes IceOptic.com to deposit on the customer’s hard disk a so-called “cookie” file whose purpose is to facilitate its identification.

 10. Delivery

The indicated delivery times have as reference the date of the order and are presented in working days (Saturday, Sunday and holidays are not taken into account in the calculation of the delivery time). The delivery times indicated by Optique Chaussin – IceOptic.com to the customer are communicated for purely indicative purposes.

If the supplier finds himself out of stock and then extends its delivery time, we will inform you by email.

If a part of the items ordered is temporarily out of stock, we will deliver it at our expense.

We will provide customs administrations with the required documents for destinations requiring customs clearance. Customs clearance fees may be requested from the customer. These fees and sums will be at your own expense and are entirely your responsibility, both in terms of declarations and payments to the competent authorities.

 11. Risks during transport

Unless otherwise stated, delivery is made to the address you indicated when ordering. Whatever delivery method you chose, parcels are insured and the risks are at the expense of the carrier, until they are handed to you against signature.
When getting the package, you must check the merchandise in the presence of the carrier and, if necessary, indicate the concerns you’re observing. Your concerns must be written, precise and detailed, on the carrier’s delivery note in the presence of the carrier or one of his employees. You must then send the carrier a registered letter with your concerns, within 3 days following the delivery and keep us informed.
Do not hesitate to refuse the parcel if the merchandise is damaged, missing or if the parcel has been opened or repackaged (except for customs clearance).
Goods accepted without reservation by the recipient at the time of delivery and/or in the absence of a letter addressed to the carrier within 3 days, are deemed to have arrived in good condition and in their entirety (number of pieces, identity in relation to the order, etc.). No claims can be accepted by Optique Chaussin – IceOptic.com and the liability of Optique Chaussin – IceOptic.com can not be incurred.

 12. Right of Return

You have the right to revoke the order for a period of fourteen days without any reason given under the Hamon Law.
The 14-day revocation period starts from the day you or a designated third party, who is not the carrier, takes possession of the goods or, in the case of partial deliveries, the last item.

To be accepted, returns must respond to the following specifications :

– The product must be in new condition.
– For electronic products and observation products, must never have been worn or used.
– Be returned in its original packaging, in good condition.
– Returned within 21 days after reception of the order.

For a return : you must inform us by email of your intentions. You must return the items using a secure carrier with insurance and a signature-based delivery method. Return charges are at your expense. Pack the item carefully in a hard box and return it to us at the following address :

For an exchange : when we receive it, we will check the condition of the items and if they comply with the characteristics of our return charter, we will proceed to the shipping of the new items.

For refund : when we receive it, we will check the condition of the items and if they comply with the characteristics of our return charter, we will proceed to the refund using the same payment method you used for the original transaction.

– The refund will take place within 7 days after reception of your package.
– The refund will be total and will include all the sums paid, including delivery charges.

 13. Legal Warranty

You benefit from the provisions of the legal guarantee of latent defects (articles 1641 et suivants du Code Civil).

You benefit from the provisions of the legal guarantee of conformity (articles L.211-4 to L.211-14 du Code de la Consommation).

The products purchased on Optique Chaussin – IceOptic.com can give right to a contractual guarantee. This is indicated on the products file presented on the website. In order to know the procedures regarding the after-sales service, for any problem or breakdown of the product, you can send us an email.

In order to benefit from the contractual warranty of the products, it is imperative for you to keep the invoice of your purchase.

The contractual guarantees do not cover:
– The replacement of consumables (batteries, bulbs, bracelets, …),
– Failures related to accessories (power cables …),
– Defects and their consequences due to the intervention of a repairer not approved by the manufacturer of the product,
– Defects and their consequences related to abnormal or non-compliant use of the product (professional, collective use …). Please read carefully the instructions supplied with the product.
– Defects and their consequences related to any external cause.
– Scratches on glasses are considered as normal wear and not covered by the warranty unless you prove that the good had this defect on delivery.

If the damage is not due to a material or manufacturing defect additional repair costs may apply. In this case you will receive by email a notification of these additional costs. You will have to choose : accept the repair and pay the expenses, or get the product back (at your expense) in the same state as it was when you returned it to us.

In case of hidden defects upon receipt of the product, we will replace it.

 14. Responsability

We use all the means at our disposal to ensure the performance of the General Conditions of Sale.
We decline any responsibility in case a delivered article does not respect the legislation of the country of delivery other than France.
We commit ourselves to bring all the care we can to the service offered to the client. Nevertheless, our liability can not be withheld in the event of breach of our contractual obligations as a result of a fortuitous event or a case of force majeure as defined by the jurisprudence of the French courts.
Our responsibility will not be engaged in case of delay due to a shortage of stock from the retailer or supplier. In addition, in case of non-substantial differences between the items presentation photos on our website and the items ordered, our responsibility will not be engaged.
The liability of the seller, his employees and any person acting on his behalf is excluded in the event of simple and slight misconduct, unless this constitutes an essential contravention of the contract.
For all the stages to access to the website, consultation, forms filling, ordering, delivery or any other service, the company Optique Chaussin – IceOptic.com has no obligation of means. In particular, any disruption in the provision of the service, or any external intrusion or presence of computer virus, can not engage the responsibility of Optique Chaussin – IceOptic.com. Similarly, any event referred to as force majeure within the jurisprudence of the Cour de Cassation fully exonerates Optique Chaussin – IceOptic.com from any liability.
Customers benefit from the guarantees granted by the brands present on the website.

 15. Applicable law and jurisdiction

Relations between the seller and the customer are subject to French law.
This agreement is subject to French law. The language of this contract is French. Any translation is only indicative.
In case of dispute with professionals and/or traders, the court of Annecy (France) will be competent. In the event of a dispute, the French courts shall have exclusive jurisdiction.
